The purpose of this section is to introduce the Notary Public to rules regarding the notarization of wills.
Upon completion of this section, you will be able to describe:
(1) Can a notary public notarize a will
(2) Should a notary public notarize a will
(3) What should a notary public do if asked to notarize a will
California State Bar Advise
If a notary public is presented with a will to notarize, the notary should suggest that the person requesting the notarization consult an attorney. If an attorney recommends that the signature of the maker of the will be notarized or if the maker of the will insists that his or her acknowledgment of the signature be taken by the notary, the notary may notarize the signature.
