The purpose of this section is to introduce the Notary Public to rules regarding immigration documents.

Upon completion of this section, you will be able to describe:

(1)   Are notaries public prohibited from notarizing immigration documents
(2)   Assisting with filling out immigration forms
(3)   Acceptable Fees Charged
(5)   Immigration specialists who are also notaries public

Notarizing Immigration Documents

Believe it or not, if you are an immigrations specialist or consultant who is also a notary public, you can notarize immigration documents. You just can’t advertise that you notarize immigration documents…DID YOU GET THAT?

Immigration Forms

Only a person who is qualified and bonded as an immigration consultant under the Business and Professional code can assist a person in filling out immigration documents.

Acceptable Fees Charged

Unless the notary public is also an attorney who is rendering professional services as an attorney, a notary public may not charge any individual more than $10.00 for assistance in filling out immigration documents.  However, as indicated above, the notary public must be a qualified and bonded immigration consultant in order to assist in filling out immigration documents.  The notary public may still charge the regular fee for notarizations performed involving immigration documents.  (KS79-GC8223)
