The purpose of this section is to
introduce the Notary Public to rules regarding confidential marriages.
Upon completion of this section, you will be
able to describe:
(1) Where to obtain a confidential marriage license
(2) How long the license is valid
(3) Geographic jurisdiction of notary public who notarizes confidential
marriages
(4) How does a notary public obtain a confidential marriage certificate
(5) Who can perform a confidential marriage
(6) Form used for confidential marriages
(7) Penalties for notary public violations
Where does a notary obtain a confidential marriage license

Confidential marriage licenses may be issued by the county clerk to a notary public pursuant to (Family Code Section 503). (Note: a notary public may not authorize a confidential marriage unless (s)he is approved by the county clerk having jurisdiction).
How Long is the License Valid For
The license is valid for a period of 90 days.
Obtaining Approval to Authorize a Confidential Marriage License

Apply for approval at
the county clerk in which the notary public resides
note: This may be a different county than the county of the notary’s
principal place of business).
· Complete the County course for confidential marriages
Where Can a Confidential Marriage License be Used?
Only in the county which the confidential marriage license is issued.
Performance of a confidential marriage
Although a notary public, with the approval of the county clerk, may AUTHORIZE confidential marriages, only a person authorized under Family Code Sections 400 to 402 (such as a priest, minister, or rabbi) can actually PERFORM the marriage.
